By accessing the CGN website at cargonova.org, creating a CGN account, requesting a freight quote, or using any service provided by CargoNova International Ltd (referred to in these Terms as "CGN", "we", "us", or "our"), you confirm that you have read, understood, and agree to be bound by these Terms of Use.

If you are using CGN services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" and "your" refers to that entity.

These Terms should be read together with our Privacy Policy and Cookie Policy, which are incorporated by reference and form part of the agreement between you and CGN.

CargoNova International Ltd is a company registered in England and Wales, trading under the brand name CGN. We provide international freight forwarding, logistics, customs brokerage, supply chain management, and express delivery services across 190+ countries worldwide.

CGN holds the necessary licences and certifications to operate as an international freight forwarder, including customs broker authorisations, IATA agency status, and relevant national logistics licences in the markets we operate in.

Subject to your compliance with these Terms, CGN grants you a limited, non-exclusive, non-transferable, revocable licence to access and use our website and services for your legitimate business purposes.

• You must be at least 18 years of age to use CGN services
• CGN services are intended for business and commercial use. Consumer use may be subject to additional protections under applicable law
• You must provide accurate, complete, and up-to-date information when creating an account or making a booking
• You must have the legal authority to ship the goods you tender to CGN, including any required export licences or permits

You may use CGN's website and services to:

• Request freight quotes and book logistics services for legitimate commercial purposes
• Track shipments and access your booking and account history
• Communicate with CGN customer service and account management teams
• Download documents, shipping labels, and invoices related to your own account
• Access publicly available information and resources on cargonova.org

You must not use CGN's website, platform, or services in any manner that is unlawful, harmful, or contrary to these Terms. The following conduct is strictly prohibited:

CGN reserves the right to refuse, suspend, or terminate any booking, account, or service where we reasonably believe a violation of these prohibitions has occurred or is likely to occur, without notice and without liability.

To access certain features of the CGN platform, including booking freight, viewing tracking history, and managing your account, you must register for a CGN account.

• You must provide accurate, current, and complete information during registration and keep your account information updated at all times
• You must be authorised to act on behalf of the company or individual you register the account for
• CGN may verify your identity and business details as part of the account registration process
• CGN reserves the right to refuse account registration at our sole discretion

• You are solely responsible for maintaining the confidentiality of your account login credentials
• You must not share your login credentials with any third party
• You are responsible for all activity that occurs under your account, whether or not you authorised it
• You must notify CGN immediately at security@cargonova.org if you suspect unauthorised access to your account

Freight services provided by CGN are subject to these Terms of Use as well as any applicable Standard Trading Conditions, carrier contracts, and international freight conventions including but not limited to the Warsaw Convention, Montreal Convention, and CMR Convention for road freight.

• All quotes provided by CGN are indicative unless confirmed in writing as a binding quote
• Prices are subject to change based on fuel surcharges, currency fluctuations, carrier rate changes, and customs duty estimates
• Final invoiced amounts may differ from quoted amounts where shipment details differ from those provided at the time of quoting

• A booking is only confirmed once CGN issues a written booking confirmation or airway bill, ocean bill of lading, or equivalent freight document
• CGN reserves the right to decline any booking at our discretion, including where goods are prohibited, undeclared, or where the booking would violate applicable law

The shipper is solely responsible for ensuring that all dangerous goods, restricted items, and hazardous materials comply with IATA, IMDG, and ADR regulations as applicable. CGN reserves the right to refuse, open, inspect, or return any shipment suspected of containing prohibited or misdeclared goods.

The importer and exporter of record are responsible for compliance with all applicable customs laws, export controls, and trade sanctions in every country of origin, transit, and destination. Where CGN acts as customs broker, we act as agent of the importer or exporter and are not responsible for the accuracy of information provided to us.

All content on cargonova.org and within CGN's digital platforms, including text, graphics, logos, icons, images, audio clips, data compilations, and software, is the property of CargoNova International Ltd or its content suppliers and is protected by applicable intellectual property laws.

• View and download content from cargonova.org for your own personal, non-commercial reference
• Share links to CGN's publicly accessible pages on social media or in correspondence
• Print a reasonable number of pages from our website for your own business records

• Reproduce, republish, upload, post, transmit, or distribute any CGN content without our prior written permission
• Use the CGN name, logo, or branding in any way that suggests an endorsement or affiliation not authorised by CGN
• Modify or create derivative works based on CGN's content or platform functionality
• Use CGN content for any commercial purpose without our express written consent

CGN integrates with third-party services including carrier tracking platforms, payment processors, and mapping services to deliver our freight and logistics functionality. Your use of those integrated services may be subject to additional terms imposed by those third-party providers.

To the fullest extent permitted by applicable law, CGN provides the website and digital platform on an "as is" and "as available" basis without warranty of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components.

CGN's liability for loss, damage, delay, or non-delivery of goods is limited as follows:

In no event shall CGN be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or loss of business opportunity, even if CGN has been advised of the possibility of such damages.

Nothing in these Terms shall limit CGN's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by applicable law.

You agree to indemnify, defend, and hold harmless CGN, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of or access to the CGN website or services in violation of these Terms
• Your violation of any applicable law or regulation, including customs, export control, or sanctions laws
• Your shipment of prohibited, restricted, or misdeclared goods
• Any inaccurate or incomplete information you provide to CGN in connection with a booking or account
• Any claim by a third party arising from your use of CGN services

CGN reserves the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our reasonable requests in connection with the defence of such matter.

Either party may terminate the agreement constituted by these Terms at any time.

You may stop using CGN services at any time. To close your CGN account, please contact our customer service team at cargonova.org/customer-service. Account closure does not affect any bookings already confirmed or invoices already issued.

CGN may suspend or terminate your access to our services or platform immediately and without notice if:

• You breach any provision of these Terms
• We are required to do so by law, court order, or regulatory directive
• We reasonably believe your account has been used for fraudulent, illegal, or abusive activity
• You fail to pay any outstanding invoices after the applicable payment terms have expired

Upon termination, your licence to use CGN's platform ceases immediately. Any provisions of these Terms that by their nature should survive termination, including intellectual property, limitation of liability, indemnification, and dispute resolution, will continue to apply.

These Terms of Use and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of CGN services shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable law requires disputes to be resolved in another jurisdiction.

Before initiating formal legal proceedings, both parties agree to use reasonable efforts to resolve any dispute informally. Please contact our legal team at legal@cargonova.org in the first instance. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.

CGN reserves the right to update these Terms of Use at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Send an email notification to all registered CGN account holders where the changes materially affect their rights or obligations
• Display a prominent notice on the CGN website for at least 30 days following any material update

Your continued use of CGN services after any updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services and may close your account as described in Section 11.
